Justice Vipin Sanghi of the Delhi High Court observed that the appellant, who is his wife, used to regularly tease her husband with overweight. The court affirmed the trial court’s decision and dismissed the appeal as mental cruelty committed by the wife.

The appellant-wife and defendant-husband got married in 2005 in Delhi and have a son from their marriage. It was alleged by the defendant-husband that the appellant-husband specifically called her “elephant” or “fat elephant” and denied having sex with the defendant-husband.

Husbands overweight

The husband filed a petition under section 13 (1) (ia) of the Hindu Marriage Act before the ADJ, Karkardooma Court, Delhi, where the court admitted that the wife had committed mental cruelty with the husband and the court gave divorce.

Against this decision, the appellant filed an appeal before the Delhi High Court where the court noted:

“Some of the above mentioned incidents are serious and weighty marital crimes / misconduct by the appellant, which cannot be described as normal wounds or tirade incidents. Such incidents are clearly destructive of the marital bond and naturally give rise to a belief in the defendant’s mind and genuine belief and apprehension that it is safe for him to continue peacefully and mentally with the appellant. Is not. “
